We will thereafter coordinate with both the winners and their registered educational institution (school) to ensure a smooth transfer of funds.

The Sponsors Of Brave Competition Terms and Conditions
Important clauses which may limit our responsibility, place an obligation on you to indemnify us,
involve an acknowledgment of any fact, or involve some risk for you will be in bold and italics. You
must pay special attention to these clauses.
- Introduction:
- The Sponsors of Brave Competition (“Competition”) will be run by Sponsors of Brave in association with Adcock Ingram Healthcare (Pty) Ltd (AIH) (collectively the organisers/we/us/our). The Competition will however, be run on behalf of the organisers by the Vividh team, who will be coordinating and running everything concerning the Competition on the Sponsors of Brave page.
- Each person entering the Competition (entrants/you/your) and/or accepting the prize in terms of this Competition agrees and accepts that the Competition rules as set out in these Terms and Conditions are binding on them.
- Competition Period:
- The Competition will include the following 2 (two) entry periods (Entry Period):
- The first Entry Period will open at 10h00 on Monday, 15 April 2024, and will close at 09h59 on Wednesday, 6 May 2024;
- The second Entry Period will open at 10h00 on Monday, 29 April 2024, and will close at 09h59 on Wednesday, 6 May 2024;
- The winner will be announced on Monday, 20 May 2024 at 15h00.
- The organisers reserve the right (in their sole and absolute discretion) to extend, shorten, or suspend any or all of the Entry Periods or to terminate the Competition for technical, commercial, and/or operational reasons, or for reasons beyond their control.

- Who Can Enter:
- In order to be eligible to enter the Competition on behalf of your child:
- You must be a legal, permanent resident or citizen of the Republic of South Africa;
- You must be at least 18 (eighteen) years of age; and
- You must be a natural person (e.g. not a company, close corporation, trust, or other similar legal entity).
- Your child must go to a Registered educational institution (school) in the Republic of South Africa.
- Notwithstanding clause 1, you are not eligible to enter this Competition if:
- You are a director, member, partner, employee, agent, or consultant of the organisers of the Competition or any other person who directly or indirectly controls or is controlled by the organisers;
- You are an immediate family member of any of the persons specified in clause 3.2.1, or
- You are a supplier of goods or services in connection with the Competition.
- In order to be eligible to enter the Competition on behalf of your child:
- How to Enter:
- We will include 1 (one) Competition post on the Sponsors of Brave Facebook page (Competition Posts) at the commencement of the Entry Period during the Competition. (i.e. a new Competition Post on a Monday for each Entry Period). To enter, you must comply with all the following requirements:
- Like & Share the posts during any one or more of the Entry Periods;
- Follow the Sponsors of Brave Facebook Page; and
- Comment on the Competition Post during any one or more of the Entry Periods, with your child’s artwork and age group category name.
- Once you meet the requirements set out in clause 3 above and this clause 4, you will automatically be entered into the Competition.
- You may enter as many times as you like on Facebook.
- No automated entries will be allowed. Entries must be made manually.
- If your entry is submitted in a manner that in the sole discretion of the organisers will provide you with an unfair advantage over other entrants, you will be disqualified from the Competition.
- You are required to attend to the cost of your entry, including standard internet costs.
- We will include 1 (one) Competition post on the Sponsors of Brave Facebook page (Competition Posts) at the commencement of the Entry Period during the Competition. (i.e. a new Competition Post on a Monday for each Entry Period). To enter, you must comply with all the following requirements:
- How The Winners Are Determined:
- There will be a total of 3 (three) winners (Winners) for the Competition. We will announce the Winners on Monday, 20 May 2024 at 15h00, The Winners will be randomly drawn by means of an automated system based on the following process:
- A random draw will be conducted through an automated system to determine the entry platform (Facebook) from which the final winners will be drawn; and
- A second random draw will be conducted through an automated system to determine the winner from the valid entries received through the entry platform determined in 5.1.1. Above.
- Sponsors of Brave will notify the Winners by messaging the Winner directly by Facebook (i.e. the platform from which the winning entry was received) within seven (7) to twelve (12) working days before the determination of the Winner Announcement post. Sponsors of Brave will request further contact details and registered educational institution (school) details, a copy of the Winner’s parents Identification Document (ID)
(as required in accordance with Regulation 11 (6) (o) of the Consumer Protection Act 68 of 2008) and any further information that may be required to validate the Winner’s entry. If the Winner does not reply to the message and provide the requested information within 48 hours ie. two working days from our message being sent, or if we determine in our sole discretion that the Winner was not eligible to enter and/or win a prize in the Competition in accordance with these Terms and Conditions, the Winner will forfeit the prize and have no claim against us and we shall be entitled to select a different winner at our discretion. - The Winner will be announced on digital platforms operated by the organisers.
- There will be a total of 3 (three) winners (Winners) for the Competition. We will announce the Winners on Monday, 20 May 2024 at 15h00, The Winners will be randomly drawn by means of an automated system based on the following process:
- The Prize:
- The winners will receive R5000 toward their child’s registered educational institution (school) fees, which will be paid directly to the school. There will be 3 winners in 3 different age groups: (1st place winner in age group 5 to 7), (1st place winner in age group 8 to 10), (1st place winner in age group 11 to 13) courtesy of Sponsor of Brave, which will be subject to the following conditions:
- The winner will be required to provide their child’s name and surname, a copy of one of the Winner’s parents Identification Document (ID) and the name and contact details of the school they attend.
- The prize does not include any other items that are not specifically stated herein.
- The prize is not transferable and may not be exchanged for any other items including cash.
- Protection of Personal Information:
- “Personal Information” has the meaning set out in section 1 of the Protection of Personal Information Act, 4 of 2013 (POPIA) and includes special personal information as defined in section 26 of POPIA meaning but not limited to; any information that may identify a natural or juristic person such as a name, surname, identity number, contact number, email address, religion, medical history, education, financial or any other information that is unique to an individual.
- The information the organisers will be processing shall be subject to section 34 and 35 of POPIA as it will be the Personal Information of children, which Inter alia states that, the processing of the Personal Information of children is subject to the prior consent of a competent person and Personal Information which has deliberately been made public by the child with the consent of a competent person.
- Each Party undertakes to fully comply with the statutory obligations contained in POPIA, especially in regards to with which the Parties warrant that they are and will remain fully conversant with, when processing (as defined in POPIA) Personal Information and such personal information is entered into a record (as defined in POPIA). Without limiting the generality of the aforesaid the Parties shall ensure that the Conditions for the lawful
processing of personal information are strictly adhered to when processing the Data Subject’s personal information. - All Parties warrant that they will, having regard to the state of technological development and the cost of implementing any measures, take appropriate security safeguards as contemplated in the POPIA, against the unauthorized or unlawful processing of Personal Information obtained through the implementation of these Terms and Conditions, and against the accidental loss or destruction of, or damage to, such Personal Information to ensure a level of security appropriate to:
- the harm that might result from such unauthorized or unlawful Processing or accidental loss, destruction or damage; and
- the nature of the Personal Information to be protected.
- The parent of the child, who will be entering the Competition on behalf of the child, warrants that they are a competent person (as defined in POPIA) and grant the organisers consent to process any Personal Information provided to the organisers by them.
- General:
- You may only win one Prize in this Competition. For the avoidance of any doubt, if a person is determined a Winner for one Entry Period, that person will not be eligible to win a Prize for any of the subsequent Entry Periods for this Competition.
- Any reference to the organisers includes the directors, members, partners, agents, or consultants of the organisers, where the context allows for it.
- We reserve the right to amend these Terms and Conditions should it be deemed necessary in our sole and unfettered discretion.
- The organisers’ decision regarding any matter concerning the Competition and/or arising out of these Terms and Conditions, including the determination of the Winner, is final and no correspondence will be entered into except where otherwise provided for in the Consumer Protection Act, 68 of 2008.
- Where relevant, we reserve the right to declare the Prize forfeited and/or to choose a new Winner if;
- a Winner does not accept the Prize as required herein;
- if an entry is not valid for whatever reason;
- if a Winner has breached these Terms and Conditions;
- if a Winner renounces the Prize; or
- if we deem such Winner to have renounced the Prize.
- Nothing in these Terms and Conditions is intended to or must be understood to, unlawfully restrict, limit, or avoid any rights or obligations, as the case may be, created for either the entrants or the organisers in terms of the Consumer Protection Act, 68 of 2008.
- By entering this Competition, the entrant consents to the collection, processing, and further processing of his or her personal information (including personal information contained in electronic communications) by us for the purposes of conducting this Competition and facilitating the entrant’s participation in the Competition. Except where prohibited by law or where objected to by the individual at any time, the Winner grants permission for us and those acting under our authority to use his or her artwork/drawings for purposes of announcing the Winner and related advertising
purposes, in any form of media and without additional compensation, notification or permission. A Winner may at any time decline an invitation to use, or object to the use of, his/her artwork/drawings in marketing material. - By posting any content, images, or comments on any of the organiser’s public and/or social media platform or by sending any such content to the organisers, an entrant consents to and gives the organisers a worldwide royalty-free licence to reproduce, modify, adapt and publish such content, images or comments for the purposes of promoting the organiser’s products and/or services.
- By entering the Competition, the entrant unconditionally and irrevocably indemnifies and holds harmless the organisers, as well as its holding company, its subsidiaries and any subsidiaries of its holding company, and their successors and assigns, directors, employees, agents or consultants against all and any losses, claims, proceeding, actions, damages (direct, consequential or otherwise), liability, demands, expenses, legal costs (on an attorney and own client basis), injuries howsoever arising out of, based upon, or in connection with (directly or indirectly) the entrant’s participation in the Competition and or the use of the Prize. By accepting the Prize, the Winner accepts the Prize at his/her own risk.
- The organisers and their service providers are not responsible for:
- Incorrect and inaccurate transcription of entry information;
- Technical malfunction;
- Inappropriate images and comments posted by the entrant or by the public;
- Lost or delayed data transmission, omission, interruption, deletion, line failure, or malfunction of any telephone network or computer equipment or software; and/or
- The inability to access any website or online services or any other error. 8.11.
- If required by the Minister of Trade and Industry, the National Consumer Commission, or for whatever other reason, we will have the right to modify or terminate this Competition with immediate effect and without notice of such modification or termination. In such an event, all entrants hereby waive any rights, which they may have against us and hereby acknowledge that they will have no recourse or claim of any nature whatsoever against us.
- The Competition is in no way sponsored, endorsed, or administered by Facebook, Instagram, or Twitter and any correspondence related to the Competition should be directed at us and not Facebook, Instagram and, or Twitter.
- We may require the Entrant to:
- To provide his/her name, proof of address, identity number, and cell number to enable us to verify the entry;
- Where the entry includes the submission of any work eligible for copyright in terms of the Copyright Act No. 98 of 1978, conclude an agreement of assignment whereby any rights which the entrant may have in respect of such works are transferred to us.
- We reserve the right to disqualify any entrant suspected of fraud or cheating including without limitation, through the manipulation of code or otherwise falsifying data.
- We reserve the right to remove/delete any entries which are in our sole and unfettered discretion deemed to be obscene and or offensive.
